General
The following terms and conditions outline Yuma Insta Booth Studios responsibilities (herein also referred to as company) and the customer/client responsibilities. Company agrees to provide services. Client agrees to rent a photo booth, audio guest book or Silent Disco for this event for the agreed upon price; the retainer is non-refundable. Final payment is due 30 days prior to the event. Client agrees to allow Yuma Insta Booth Studios to use client photos for marketing purposes. If you do not wish for your photos to be on social media or in any of our advertising please inform us in writing, we are more than happy to accommodate your request.
Venue
Company will arrive approximately 45 minutes prior to the agreed upon start time for setup. Company requires a space of 10 – 15 feet for the photo booth at event’s venue. Client is responsible for providing power for the photo booth with a 3-prong outlet. In the event of an outdoor event client is responsible for providing a level area of ground for photo booth and a roof, awning, or canopy to block direct sunlight and or potential inclement weather. Company is not responsible for any temporary interruption to services due to inadequate AC power or weather conditions to include inability to set up our backdrop in windy conditions. In extreme weather conditions we reserve the right to end our services in order to protect our equipment. No refunds will be issued for weather conditions.
Payment Terms and Cancellations
Company accepts payment in form of cash or debit/credit card made payable to Yuma Insta Booth Studios Photo Booth. We will accept checks only from our corporate clients. A retainer in the amount of 25-50% is required and non-refundable on date of booking. Remaining balance is due 30 days prior to your event. You, the client do hereby agree to pay the total contract amount for the entertainment services of the company. This agreement is subject to accidents, epidemics, acts of God or any other legitimate condition beyond Company control. If such circumstance arise, all reasonable efforts will be made by the Company to find a replacement entertainment at the agreed upon fees. Should company be unable to procure a replacement, the client will receive a refund minus the non-refundable retainer. Any cancellations received in writing from the client that are less than 90 days notice are non-refundable but events can be rescheduled. By signing our signatures below, both parties(Company and Client) agree to these contract terms and conditions.
Damages and Indemnification
Client acknowledges that they shall be responsible for any damage or loss to the Provider’s Equipment caused by any misuse of the provider’s equipment by Client or its guests both invited and uninvited. Client will indemnify provider against any and all liability related to Client’s event during or after Client’s event. Client will indemnify provider from the time of service and on into the future, against any liability associated with Client. Client will indemnify provider against any and all liability associated with the use of pictures taken within the Yuma Insta Booth Studios Photo Booths its representatives, employees or affiliates at Client’s event.
Refusal
Client acknowledges Company shall have the right to decline service to client’s guest (invited or uninvited), for misuse, inappropriate photos or unruly behavior.
Scope of Work
Operations:
1. Provide a fully operational photo booth (including all photos) within the rental agreement for no additional charge or fee. Client is aware that onsite maintenance &/or servicing of the photo booth may be required & acknowledges that, as a result, minor delays &/or interruptions in service may be experienced. However, Provider will seek to fulfill the full duration of time contracted herein even in the event of delays / interruptions. If you have a package with prints and our printer is unable to perform we will refund you $100 which is the cost of the upgrade to prints.
2. Provide an onsite attendant to monitor the DSLR photo booth, assist guests in using the photo booth & perform any necessary maintenance throughout the time of the event.
3.Coordinate set-up & removal of photo booth within designated time frame.
